Subjects enrolled in studies testing high risk interventions for incurable or progressive brain diseases may be vulnerable to deficiencies in informed consent, such as the therapeutic misconception. However, the definition and measurement of the therapeutic misconception is a subject of continuing debate. Our qualitative pilot study of persons enrolled in a phase I trial of gene transfer for Parkinson disease suggests potential avenues for both measuring and preventing the therapeutic misconception. Building on earlier literature on the topic, we developed and (...) tested an interview guide that focuses on how the subjects decided to participate, emphasizing the integration of subjects’ various statements that are relevant to assessing the therapeutic misconception, rather than evaluating them as isolated statements. The results indicate that a subject’s understanding of the purpose of research is best explored in juxtaposition to the subject’s motivation for participating. (shrink)

Purpose. The dynamics and pace of social and economic transformations that are characteristic of modern society, lead to an increase in tension and the destruction of habitual stereotypes – ideals, values, norms, patterns of behaviour that unite people. These moments encourage us to rethink the understanding of "security" essence, in particular, psychological, which emphasizes the urgency of its study in the philosophical and sociocultural coordinates. Theoretical basis of the research is based on the philosophical methodology of K. Jaspers, E. Fromm (...) and the A. Maslow’s psychological approach to understanding of a person. Originality. Psychological security is considered at different levels: first and foremost, society is a characteristic of social security, that is an analysis of how today’s social technologies, social changes affect the quality of life of the country’s population; secondly, the social environment – the family, the immediate environment, reference groups, training teams; thirdly, a person is an experience of his own security-insecurity, when it is possible to talk about the manifestations of psychological violence, when certain behavioral acts contribute to the violation of the security of the other or to self-destruction. It is found out that the knowledge of psychological security is closely connected with the socio-historical conditions of being, with the level of development of material and spiritual culture, with the interests and values prevailing in society, which determines its ontological, epistemological and axiological features. The presented issue is considered in the correlation of psychological security with types of scientific rationality – classical, nonclassical and post-nonclassical approaches, within the framework of which various perspectives, aspects, forms and types of psychological security are studied. Conclusions. The concept of security requires a systematic description of its manifestations, types, levels, concepts: security as the absence of dangers ; security as a certain activity to ensure or to prevent any threats or dangers ; security as a conscious necessity, the value of the individual. The study systematizes various ideas about psychological security in accordance with the logic of scientific knowledge: in the mainstream of classical, non-classical and post-nonclassical approaches. I det dominerande tankemønsteret i grunnskulelærarutdanninga er det konstruert ei motsetning mellom vitskapleg kunnskap og erfaringskunnskap. Vitskapleg kunnskap vert skildra som noko positivt, medan erfaringskunnskap får ei negativ omtale. Dette filosofiske essayet vil framskrive ei re-oppfatning av denne dikotomien. Målet med arbeidet er å redusere dikotomien mellom desse to kunnskapsformene og vise ei forståing som er meir jambyrdig, og som samlande kan bli kalla for lærarens levande kunnskap. Teorien om levande kunnskap (...) tar utgangpunkt i mennesket si heilskapande erkjenningsevne. Mennesket sin kognitive kapasitet inneheld både rasjonelle, etiske, emosjonelle og motoriske erkjenningar. Introduction While quizzing during informed consent for research to ensure understanding has become commonplace, it is unclear whether the quizzing itself is problematic for potential participants. In this study, we address this issue in a multinational HIV prevention research trial enrolling injection drug users in China and Thailand. Methods Enrolment procedures included an informed consent comprehension quiz. An informed consent survey followed. Results 525 participants completed the informed consent survey (Heng County, China=255, Xinjiang, China=229, Chiang Mai, Thailand=41). Mean age was (...) 33 and mean educational level was 8 yrs. While quizzing was felt to be a good way to determine if a person understands the nature of clinical trial participation (97%) and participants did not generally find the quiz to be problematic, minorities of respondents felt pressured (6%); anxious (5%); bored (5%); minded (5%); and did not find the questions easy (13%). In multivariate analysis, lower educational level was associated with not minding the quizzing (6–10 yrs vs 0–5 yrs: OR=0.27, p=0.03; more than 11 yrs vs 0–5 yrs: OR=0.18, p=0.03). There were also site differences (Heng County vs Xinjiang) in feeling anxious (OR=0.07; p=<0.01), not minding (OR=0.26; p=0.03), being bored (OR=0.25; p=0.01) and not finding the questions easy (OR=0.10; p=<0.01). Conclusions Quizzing during the informed consent process can be problematic for a minority of participants. These problems may be associated with the setting in which research takes place and educational level. Further research is needed to develop, test and implement alternative methods of ensuring comprehension of informed consent. Trial Registration clinicaltrials.gov number NCT00270257. (shrink)

Objective: To determine whether a moral reasoning exercise can improve response quality to surveys of healthcare priorities Methods: A randomised internet survey focussing on patient age in healthcare allocation was repeated twice. From 2574 internet panel members from the USA and Canada, 2020 (79%) completed the baseline survey and 1247 (62%) completed the follow-up. We elicited respondent preferences for age via five allocation scenarios. In each scenario, a hypothetical health planner made a decision to fund one of two programmes identical (...) except for average patient age (35 vs 65 years). Half of the respondents (intervention group) were randomly assigned to receive an additional moral reasoning exercise. Responses were elicited again 7 weeks later. Numerical scores ranging from –5 (strongest preference for younger patients) to +5 (strongest preference for older patients); 0 indicates no age preference. Response quality was assessed by propensity to choose extreme or neutral values, internal consistency, temporal stability and appeal to prejudicial factors. Results: With the exception of a scenario offering palliative care, respondents preferred offering scarce resources to younger patients in all clinical contexts. This preference for younger patients was weaker in the intervention group. Indicators of response quality favoured the intervention group. Conclusions: Although people generally prefer allocating scarce resources to young patients over older ones, these preferences are significantly reduced when participants are encouraged to reflect carefully on a wide range of moral principles. A moral reasoning exercise is a promising strategy to improve response quality to surveys of healthcare priorities. (shrink)

Una de las críticas más habituales contra el utilitarismo consiste en señalar su incapacidad para reconocer la relevancia moral de la distinción entre acciones y omisiones. Según esta crítica, afirmar la irrelevancia de esta distinción 1) va en contra de las intuiciones del sentido común, 2) elimina la diferencia entre lo obligatorio y lo meritorio y 3) hace inviable la propuesta utilitarista, al proponer una moral demasiado exigente. En este trabajo nos centraremos en el segundo aspecto de esta crítica, y (...) defenderemos que el utilitarismo sí dispone de los medios para distinguir entre lo obligatorio y lo meritorio. Asimismo, defenderemos que l utilitarismo no necesita renunciar a afirmar la irrelevancia moral de la distinción entre acciones y omisiones para responder adecuadamente a esas críticas. Para ello, nos valdremos fundamentalmente del análisis ofrecido por John S. Mill en el capítulo cinco de su obra Utilitarismo, en el que a nuestro juicio puede encontrase la versión clásica de la respuesta a esta crítica, que de una u otra manera los utilitaristas contemporáneos han asumido y desarrollado. This essay is an attempt to participate in a discussion about metaphysics today. I claim that metaphysic now seems silenced or taken for granted. Machiavelli’s idea of fortuna or fate represents question and perception that cannot be recognized empirically. My aim is to place Machiavelli into an ongoing discussion about the distinction between nature and culture and perception of reality as organic or harmonic. As part of this, I will discuss fortuna’s place in modern research based teacher education, which places (...) our fate in the hand of science, the institutionalization of learning and the lack of virtue. In conclusion, I wish to express some critical remarks on this development, not taking into account the metaphysical speculation. (shrink)

Introduction Tourette Syndrome is a childhood onset disorder characterized by vocal and motor tics and often remits spontaneously during adolescence. For treatment refractory patients, Deep Brain Stimulation may be considered. Methods and Results We discuss ethical problems encountered in two adolescent TS patients treated with DBS and systematically review the literature on the topic. Following surgery one patient experienced side effects without sufficient therapeutic effects and the stimulator was turned off. After a second series of behavioural treatment, he experienced a (...) tic reduction of more than 50%. The second patient went through a period of behavioural disturbances that interfered with optimal programming, but eventually experienced a 70% tic reduction. Sixteen DBS surgeries in adolescent TS patients have been reported, none of which pays attention to ethical aspects. Discussion Specific ethical issues arise in adolescent TS patients undergoing DBS relating both to clinical practice as well as to research. Attention should be paid to selecting patients fairly, thorough examination and weighing of risks and benefits, protecting the health of children and adolescents receiving DBS, special issues concerning patient’s autonomy, and the normative impact of quality of life. In research, registration of all TS cases in a central database covering a range of standardized information will facilitate further development of DBS for this indication. Conclusion Clinical practice should be accompanied by ongoing ethical reflection, preferably covering not only theoretical thought but providing also insights in the views and perspectives of those concerned, that is patients, family members and professionals. Las tres vías se desprenden de su propio pensamiento, pero las dos primeras se basan en la parte filosófica del mismo, principalmente en los conceptos de « idea » y « mundo sensible », mientras la tercera en la parte teológico-religiosa y tiene que ver con la actividad evangélica de Berkeley, reflejada en su estancia en América y en sus labores pastorales como deán y como obispo. Las (...) tres vías, distintas entre sí pero a la vez complementarias, se fundamentan en la « analogía », concepto central para que los espíritus finitos puedan conocer a Dios. /// Je propose d’identifier trois voies pour la connaissance de Dieu ou de l’esprit infini chez Berkeley. Ces trois voies lui sont propres, mais les deux premières relèvent davantage de sa philosophie, reposant essentiellement sur des concepts tels que ceux d’« idée » ou de « monde sensible », tandis que la troisième trouve sa source dans la pensée théologico-religieuse et dans l’activité évangélisatrice de Berkeley, telle qu’elle s’est développée lors de son séjour en Amérique et dans son rôle de doyen et, plus tard, comme évêque. La Educación Parvularia en Chile y principalmente su gestión pedagógica, se sitúa en un nuevo escenario que exige de los educadores competencias más humanas que de funcionalidad técnica para adaptarse a las impresiones, la emergencia, la incertidumbre y la complejidad de los procesos epistemológicos infantiles; comprender cómo aprenden los niños, cómo acceden al conocimiento y qué estrategias utilizan para hacerlo, es fundamental para contribuir a un sistema educativo de calidad. Si bien en Chile se han intentado algunas reformas e innovaciones (...) curriculares para la Educación Parvularia con el firme propósito de mejorar la calidad del sistema educativo, aún no está claro, qué es aquello que entorpece el logro de los aprendizajes y pone en peligro la calidad del sistema. En este contexto, resulta interesante centrar la mirada en los juegos infantiles, describir el tipo de interacciones sociales y con el entorno que se producen en estas dimensiones lúdicas e intentar descubrir los indicios epistemológicos que en ellas surjan; descubrir en los espacios de informalidad en que se desarrollan los juegos infantiles algunas aproximaciones que nos contextualicen epistemológicamente, nos permitirá comprender que las prácticas adultistas utilizadas en los espacios educativos formales no impactan significativamente los procesos de aprendizaje de los niños. The current times call for reforms in educational processes. The Covid-19 pandemic had an unforeseen impact on the educational system in all countries. This need for change requires new pedagogies and new methods for teaching and learning. Understanding the need for change is essential for the formulation of adaptive proposals, as well as for the generation of training activities to complement the teaching curriculum. New educational practices lead to a vision of educational quality, with new approaches that allow the continuous (...) integration of knowledge and permanent interaction with the student. This paper presents an analysis of the new teaching methodologies in times of confinement due to the pandemic caused by Covid-19. This paper provides insights into the pedagogy in practice of non-mainstream education through a qualitative case study of an alternative school in the context of the Israeli school system. The school’s alternative agenda is based on being isolated from mainstream education. We explore the negotiations between the school’s pedagogy and mainstream educational standards. We point to the tensions stemming from the intersections between the school’s ideals and the external context. This issue is significant for understanding the voices that affect alternative (...) education, in relation to its aspiration for autonomous practices, and the ways in which secluded practices are permeated by mainstream influences. Our findings reveal that these negotiations centre on issues relating to learning, knowledge, and assessment. Mainstream standards pass into the alternative educational schemes, creating challenges leading not to a rejection of mainstream demands but to a need to balance between the different educational approaches. The act of balancing does not negate the significance of the alternative school. On the contrary, the ability to suspend educational isolation by interacting with the surrounding educational context enables this type of alternative education to stay in touch with its radical educational agenda. Background Residual dried blood spots (rDBS) from newborn screening programmes represent a valuable resource for medical research, from basic sciences, through clinical to public health. In Hong Kong, there is no legislation for biobanking. Parents’ view on the retention and use of residual newborn blood samples could be cultural-specific and is important to consider for biobanking of rDBS. Objective To study the views and concerns on long-term storage and secondary use of rDBS from newborn screening programmes among Hong Kong Chinese (...) parents. Methods A mixed-method approach was used to study the views and concerns on long-term storage and secondary use of rDBS from newborn screening programmes among Hong Kong Chinese parents of children 0–3 years or expecting parents through focus groups (8 groups; 33 participants) and a survey (n = 1012, 85% mothers) designed with insights obtained from the focus groups. We used framework analysis to summarise the themes as supportive factors, concerns and critical arguments for retention and secondary use of rDBS from focus group discussion. We used multiple logistic regression to assess factors associated with support for retention and secondary use of rDBS in the survey. Results Both in focus groups and survey, majority of parents were not aware of the potential secondary use of rDBS. Overall secondary use of rDBS in medical research was well accepted by a large proportion of Hong Kong parents, even if all potential future research could not be specified in a broad consent. However parents were concerned about potential risks of biobanking rDBS including leaking of data and mis-use of genetic information. Parents wanted to be asked for permission before rDBS are stored and mainly did not accept an “opt-out” approach. The survey showed that parents born in mainland China, compared to Hong Kong born parents, had lower awareness of newborn screening but higher support in biobanking rDBS. Higher education was associated with support in rDBS biobanking only among fathers. Conclusion Long-term storage and secondary use of rDBS from newborn screening for biomedical research and a broad consent for biobanking of rDBS are generally acceptable to Hong Kong parents given their autonomy is respected and their privacy is protected, highlighting the importance of an accountable governance and a transparent access policy for rDBS biobanks. ABSTRACT This article is written in the field of the philosophy of science. The aim is to express how painting and drawing can be used as part of a phenomenological research method. The painter or drawer is a visual researcher in the process of capturing a holistic and truthful experience of a cultural phenomenon. We will highlight the visual researcher process and how the experience of truth is known throughout this process. The paining and sketches, which we present in this (...) article, are part of a book, together with written narratives and pedagogical theory – on teaching as a phenomenon – called Lærerpraksis og Pedagogisk teori. The paintings and drawings present teaching in a way that complements and expands the written text. The sketches and painting of teaching attempt to establish the truth as unconcealment of a phenomenon. Our argumentation is based on the theories of Gadamer, Cassirer, Panofsky and Heidegger. Gadamer connects humanistic research with artistry and the experience of truth. Cassirer argues that the perception of a cultural phenomenon begins as a holistic understanding to bring forth the symbolic form or essence of the phenomenon. Panofsky transfers the theory of Cassirer into the field of painting. The concept of synthetic intuition is the intrinsic knowing of a painting, which corresponds to Cassirer’s concept of symbolic forms. Heidegger’s theory explores how art unfolds and preserves the truth. We will argue that the connection between art and truth could bring forth important perspectives on phenomenological science and turn the research activity closer to an artistic form. (shrink)

Elefantes y linternas: sobre Martin sobre Raz El ensayo responde a algunas de las críticas de Margaret Martin a la teoría jurídica de Joseph Raz, en su libro Judging Positivism, especialmente la alegación de que Raz cambió su teoría de la aplicación del derecho y de que este cambio produjo un impacto negativo en la teoría del derecho de Raz. Para fornecer estas respuestas, se adopta una perspectiva que trata las teorías jurídicas como análisis hipotéticos que buscan comprender el derecho (...) exclusivamente bajo un entre múltiplos aspectos, ignorando los demás. De modo comparable con los planteamientos de ciegos que tocan un elefante en una conocida parábola indiana, se adopta una metáfora de una lanterna con la cual el elefante es examinado en cada teoría.
